Job Description
The Depositary Officer will have the following responsibilities:
Oversee and monitor the depositary operations for the vehicles held at the Branch, ensuring compliance with the following regulations:

  • Regulation (EU) No 231/2013 of the Commission, which supplements Directive 2011/61/EU on AIFMs, focusing on exemptions, general conditions, depositaries, leverage, transparency, and supervision.
  • Delegated Regulation (EU) 2016/438, which complements Directive 2009/65/EC on UCITS in relation to the obligations of depositaries.
  • Luxembourg local regulations applicable to the type of deposited vehicles.

Review and prepare the necessary periodic documentation to be submitted to the CSSF (Commission de Surveillance du Secteur Financier), ensuring full compliance with regulatory obligations.
Supervise the custody of securities and cash related to investment funds, including verifying that reconciliations are conducted in line with internal policies, which align with applicable regulations.
Participate actively in the selection, supervision, and monitoring of sub-custodians holding securities on behalf of the vehicles deposited at the Branch, ensuring their activities meet the required standards.

The Successful Depositary Officer Has The Following Profile

  • Minimum of 3 years of experience in a depositary role within Luxembourg, with a thorough understanding of local financial regulations and European directives governing depositary services for UCITS and AIFs.
  • A degree in Finance, Economics, Business Administration, or a related field. Postgraduate qualifications in financial law or certifications related to depositary functions are a plus.
  • Strong understanding of the Luxembourg financial regulatory environment, particularly in relation to UCITS and AIFs.
  • Familiarity with CSSF reporting requirements and European regulations.
  • Excellent analytical and problem-solving skills, with an ability to manage complex regulatory requirements.
  • Proven ability to work both independently and within a team, with a proactive approach to managing depositary functions.
  • Fluent in Spanish and English
